Summary Dissolution in California

Divorce proceedings can be extremely complicated and can involve a lot of paperwork. It takes time and money and involves several processes. However, there is a type of divorce that is less complicated and involves more straightforward paperwork – summary dissolution.

The official word for a regular divorce is “dissolution” in California and is sometimes referred to as a regular dissolution. A “summary dissolution” differs from a regular dissolution because it does not require a hearing or mediation and can be completed in six months. Summary dissolution is the shorter and simpler way to get divorced, but not all people are eligible for this.

Who Is Eligible for a Summary Dissolution?

The couples who are eligible for summary dissolution are those who:

  1. Are married or in a domestic partnership for less than five years from the date of marriage to the date of separation

  2. Have no children together

  3. Do not owe or own much together

  4. Do not need spousal or domestic partner support from each other

  5. Agree upon how to split any community property

All of the above criteria must be met for a couple to be eligible for a summary dissolution. Though you do not need to appear in court or need a lawyer for this procedure, it is best to consult with an attorney.

Summary Dissolution Procedure

For the summary dissolution, you need to file a few forms – the joint petition for summary dissolution and a potentially property settlement agreement must be submitted to a superior court clerk in your county. You will also have to submit the judgment of dissolution and notice of entry of judgment. There are also a few more forms related to finances that need to be exchanged.

After you have submitted the required documents, the process could take up to 6 months. The court will mail you or your attorney the judgment; you might also have to submit two envelopes with your addresses on them.
